In July of 2023, our client was stopped at a traffic signal that was red. When the light changed to green, he began moving into the intersection, waiting for oncoming traffic to clear so he could turn left. While in the intersection, our client was struck by a motor vehicle coming into the intersection.
From my client’s perspective (and another initially unidentified witness), the light that the other driver had as she entered the intersection was red. Unfortunately, she said otherwise when she was being interviewed by the police who came to the scene after the accident. Additionally, another witness that was present at the scene and interviewed by the police confirmed our client’s position-- -that his light was green as he entered the intersection and that the other driver “ran” a red light.
Unfortunately, the police officer responding to the scene did not identify the name of the other witness who confirmed our client’s position that his light was in fact green when he entered the intersection.
Through the efforts of Barberi Law, we were able to secure the necessary information to convince the other driver’s insurance company that she was indeed at fault, and had entered the intersection while the light was red. Our firm’s involvement in quickly hiring our own investigator to run down the additional information necessary to make this case a viable claim demonstrates how important it is to contact an experienced personal injury attorney within 72 hours of an accident occurring.
We at Barberi Law are happy to report that in 2025 we were able to hand our client a large six figure check to compensate him for all that he had gone through and will likely go through in the future. Our client will likely be facing orthopedic surgery down the road as a result of a severe injury to his knee.
Additionally, during the claim negotiation process, we set a goal that we believed to be a fair amount to compensate our client without having to file a lawsuit. I am happy to report that as the negotiations were being concluded, we set a minimum amount to receive in order to have us not file a lawsuit, and we were able to convince the adjuster for the insurance company that this amount was a number they could afford to pay our client. The adjuster confided to our staff that after reviewing the successes that Barberi Law had had in other cases, she became convinced that it was in the insurance company’s best interest to settle, rather than to face us in court.
The success in compensating our client occurred as a result of a team effort, and a large degree of this success goes to Paralegal, Lori Erskin, who prepared a wonderful demand letter that documented the nature and extent of our client’s injuries. That’s why at Team Barberi everything we do, we do better because we do it together!
